1.1 Irrevocable Transfer of Ownership and Consent to Use

By submitting Content to BlueBirdRP, the User irrevocably transfers all rights, title, and interest in and to the Content to BlueBirdRP, including all transferable intellectual property rights and any associated assets related to the Content, whether they exist currently or are developed in the future.

To the fullest extent permitted by law, the User also gives BlueBirdRP irrevocable, ongoing, worldwide and royalty-free consent to use, modify, adapt, edit, convert, optimise, rename, retexture, recolour, combine, display, distribute, licence, sublicense, publish, communicate, remove, archive, replace, not use, cease using, and otherwise deal with the Content in connection with BlueBirdRP services, servers, websites, stores, social media, promotional material, development work, internal systems, community platforms and related projects.

To the fullest extent permitted by law, this consent includes consent for BlueBirdRP to use the Content without attribution, to attribute the Content in a manner chosen by BlueBirdRP, to not identify the User as the creator or contributor, to make changes to the Content that may alter its appearance, function, quality, format, context or meaning, and to use the Content in ways that may otherwise affect the User’s moral rights, provided BlueBirdRP does not falsely attribute authorship of the Content to another person.

The User acknowledges that this consent is given freely and voluntarily, is intended to be relied on by BlueBirdRP, and continues even if the User later leaves the community, is banned, is removed, changes their mind, disagrees with how the Content is used, or no longer supports BlueBirdRP.

1.2 No Retention of Control or Removal Rights

Once submitted, the User relinquishes all control over the Content to the fullest extent permitted by law. The User must not request, demand or require the removal, modification, withdrawal, disabling, replacement, return, refund, reversal or discontinuation of the Content from BlueBirdRP’s server, assets, platforms, stores, websites, social media, development files, archives or related services.

The User acknowledges that BlueBirdRP may continue to use, modify, retain, archive, remove, replace or cease using the Content at BlueBirdRP’s discretion, and that the User’s later dissatisfaction, change of mind, community status, account status, ban, restriction, disagreement, or loss of access does not create any right to control the Content or require BlueBirdRP to remove it.

1.3 Content Submission Process

All Content must be submitted through CFX Keymaster, using the transfer function to the "BlueBirdRP" account. The User must confirm that the Content is accessible and transferable in this manner. Any Content not submitted via this process may not be accepted or credited to BlueBirdRP.

2.1 BlueBirdRP's Right to Use

BlueBirdRP reserves the right to use, modify, adapt, or remove any Content submitted as it deems appropriate. Content may be altered, combined with other materials, and utilised in any manner deemed necessary by BlueBirdRP to fit within its server’s framework and aesthetic.

2.2 Modification and Timeline

If a donation requires a paid service through any BlueBirdRP store, the User agrees that BlueBirdRP will integrate the Content at its discretion and on its own timeline. Due to the constraints and dependencies associated with the CFX Keymaster system, BlueBirdRP retains sole authority to determine if and when the Content will be added or if it will function effectively on the server. If it is determined that the Content is incompatible with the server, it cannot be returned or refunded to the User, except where required by applicable law or another right or remedy that cannot be excluded.

2.3 Content Removal and Discretion

BlueBirdRP may, at its discretion, remove or cease using any Content if it no longer fits within its platform's objectives, technical framework, or visual style. The User holds no authority over how or when Content is used or if it is discontinued.

3.1 Ongoing Compliance Requirements

The User agrees to follow all BlueBirdRP Community Guidelines, both at the time of submission and continuously thereafter. Any breach of these guidelines, including any disciplinary actions resulting in a ban or restriction from BlueBirdRP’s services, does not grant the User any authority to demand the removal of previously donated Content.

3.2 Guideline Violations and Consequences

BlueBirdRP reserves the right to retain any Content contributed by the User regardless of their access or standing within the community. Should the User’s account become restricted, banned, or otherwise unable to access BlueBirdRP services, this does not alter or negate the terms of this Agreement.

4.1 No Return Policy

Given the nature of digital asset donations, BlueBirdRP maintains a strict no-return policy, except where a return, refund or other remedy is required by applicable law or another right or remedy that cannot be excluded. Once Content is submitted, all rights and ownership are irrevocably transferred to BlueBirdRP. The User acknowledges that the functionality of the CFX Keymaster system renders the retraction or return of Content infeasible.

4.2 Limitations of Liability

To the fullest extent permitted by law, BlueBirdRP is not liable for any inconvenience, perceived loss, or dissatisfaction related to the submitted Content. The User waives any right to claim damages, refunds, or recompense, whether financial or otherwise, resulting from the use or non-use of the donated Content, except where such right or remedy cannot lawfully be excluded.

5.1 Global Jurisdiction

This Agreement applies to all Content submitted to BlueBirdRP, regardless of the User's location or jurisdiction. Users from outside Australia explicitly agree to abide by the terms of this Agreement under the laws of Australia.

5.2 Governing Law and Venue

This Agreement is governed by the laws of Queensland, Australia, without regard to any conflict of law provisions. In the event of any legal dispute, the parties agree to submit to the exclusive jurisdiction of the courts of Brisbane, Queensland, Australia.

6.1 Right to Transfer

The User represents that they own all rights, title, and interest in the Content submitted to BlueBirdRP and that the Content is free of any liens, encumbrances, or claims by third parties. By submitting Content, the User warrants that they have the full legal right to transfer ownership to BlueBirdRP.

6.2 Voluntary Submission

The User confirms that they are providing the Content voluntarily and without any undue influence or promise of compensation. Submission of Content through BlueBirdRP’s designated process constitutes acceptance of this Agreement and an understanding of its binding nature.

7.1 Entire Agreement

This Agreement constitutes the entire agreement between the parties regarding the Content submitted to BlueBirdRP. Any modifications, amendments, or waivers of this Agreement must be in writing and signed by both parties.

7.2 Acknowledgment of Agreement

By ticking the checkbox indicating agreement with the Terms and Conditions, the User acknowledges their understanding and acceptance of this Agreement in full, and their intent to be legally bound by all terms set forth herein.
